    Members of the Association participated in the meeting of the NGO "Association of Investigative Judges of Ukraine"

    On December 3, 2015, a meeting dedicated to the anniversary of the establishment of the NGO "Association of Investigating Judges of Ukraine" was held at the Kyiv District Court of Odessa, which was attended by members of the All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Detective Activities.

    The event was attended by: the chairman of the Kyiv District Court of Odessa, the chairman of the NGO "Association of Investigating Judges of Ukraine" Chvankin S.A.; the chairman of the Qualification and Disciplinary Commission of the Odessa Region Bar Association, vice-president of the Ukrainian Bar Association Bronz I.L.; the acting prosecutor of the Suvorov District of Odessa Kostenko S.K.; the judge of the Kyiv District Court of Odessa Borshchov I.S.; the judge of the District Court of the State of Florida (USA) Mark Speiser and others.

    During the meeting, the report of the Association of Investigative Judges of Ukraine for 2015 was presented to the attention of those present, the work plan for the coming year was announced, and the strategy and prospects for its further development were determined.

    At the meeting, the participants considered issues related to: the application of the provisions of the Criminal Procedure Code of Ukraine regarding the seizure of property, changes in the procedure for filing an appeal against the ruling of an investigating judge, unmotivated recusals (self-recusals) of investigating judges and judges, and ways to solve this problem, and foreign guests shared their experience of conducting legal proceedings in Bulgaria and the role of judges during pre-trial investigations in the USA.

    Let us recall that the Association of Investigative Judges of Ukraine is a public organization, the main purpose of which is to promote the development of the principle of the rule of law in Ukraine, the development of civil society and the rule of law through a mechanism of action and further continuous improvement of legal relations in the field of criminal justice.

    Members of the Association actively participate in the international training "Information Analysis in Investigating Money Laundering and Corruption Cases"

    On December 7, 2015, the Odessa State University of Internal Affairs, for the first time in Ukraine, launched the training "Information Analysis in Investigating Money Laundering and Corruption Cases", initiated by the United Nations Office on Drugs and Crime (UNODS).

    The training was attended by more than 20 representatives from the Criminal Intelligence Department of the National Police of Ukraine, the Interpol Ukrburo of the Ministry of Internal Affairs of Ukraine, the Economic Protection Department of the National Police of Ukraine, the Main Directorate of the National Police of Ukraine in Lviv Region, the National Academy of the Security Service of Ukraine, the National Anti-Corruption Bureau of Ukraine, the National Academy of Internal Affairs, etc.

    Traditionally, the event was opened by the rector of the Odessa State University of Internal Affairs, Korystin O.E., welcoming everyone present at our university, and introducing the distinguished guests: the head of the UNODC Global Program on Combating Money Laundering, Feshchenko O.Yu., the World Bank Asset Recovery Advisor, Nigel Bartlett, the expert of the UNODC Global Program on Combating Money Laundering, Bugayets Kateryna, and others.

    The purpose of this course is to provide analysts and operational staff with the knowledge necessary to analyze large volumes of information from various sources and form correct analytical conclusions from this information.

    It should be noted that the training will last from December 7 to 18, 2015. 22 sessions will be held for its participants, during which they will be able to consider issues related to: the analytical process; analysis of relationships; formation and evaluation of conclusions; analysis of telephone conversations; drawing up diagrams, flows, events and actions; concepts and strategies of analysis using a computer, etc.

    Upon completion of the two-week course, participants will receive an ANACAPA & UNODS certificate.

    The express analysis materials present the results of a survey of practical workers of investigative and operational units of internal affairs bodies on the practice of using a new criminal procedural institution – covert investigative (search) actions – during pre-trial investigations.

    Scientists discussed problematic aspects of the application of the norms of the CPC of Ukraine

    Scientists from the Odessa State University of Internal Affairs took part in the All-Ukrainian Scientific and Practical Conference “Application of the Provisions of the Criminal Procedure Code of Ukraine: Problems and Ways to Solve Them”, which was held on November 20, 2015 at the Conference Complex of the National University of the State Tax Service of Ukraine in Irpin.

    It should be noted that this event was held with the assistance of the All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Detective Activities, the founders of which are scientists from the State Department of Internal Affairs, the State Fiscal Service of Ukraine, the Main Investigation Department of the Federal Service for Internal Affairs of the State Fiscal Service of Ukraine and the National Academy of Internal Affairs.

    The organizing committee of the conference was headed by: Pashko P.V. - Acting Rector of the National University of the State Tax Service of Ukraine, Doctor of Economics, Professor; Korystin O.E. - Rector of the Odessa State University of Internal Affairs, Doctor of Law, Professor, Chairman of the All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Investigative Activities; Chernyavsky S.S. - Vice-Rector of the National Academy of Internal Affairs, Doctor of Law, Professor; Melnyk V.I. - Head of the General Directorate of the Federal Tax Service of the State Tax Service of Ukraine, Colonel of the Tax Police.

    Representatives of various academic schools discussed a significant number of topical and problematic issues regarding the current state of application of the provisions of the current Criminal Procedure Code of Ukraine.

    In particular, among the thematic areas of the conference work should be identified:
    — Evidence and procedural sources of evidence: problems of collection (obtaining) and use.
    — Beginning of pre-trial investigation in criminal proceedings.
    — Current problems of conducting investigative (search) actions and using their results in proving.
    — Interaction of the investigator and the employee of the operational unit in criminal proceedings.
    — The prosecutor as a participant in criminal proceedings.
    — Current issues of international cooperation in criminal proceedings.
    — Special procedures of criminal proceedings.
    — Features of conducting covert investigative (search) actions and using their results in criminal proceedings.
    — Criminal procedural and operational-search support of tax security in Ukraine.
    Based on the results of the scientific and practical conference, the participants developed a resolution on individual areas of law enforcement activity.

    Concept of development of criminal intelligence of the internal affairs bodies of Ukraine: scientific project / S.V. Albul, O.E. Korystin. – Odesa: ODUVS, 2015. – 20 p.

    The Concept of development of criminal intelligence of the internal affairs bodies of Ukraine defines the main directions and principles of improving the management, organizational and staffing structure, legal, personnel, resource, scientific and other support for law enforcement activities of the internal affairs bodies of Ukraine in the specified area based on the analysis and assessment of the state of security of the individual, the state and society in the field of combating crime.

    As a scientific project, the Concept corresponds to clause 1 of article 3 of the Law of Ukraine dated 11.07.2001 No. 2623-ІІІ “On priority areas of development of science and technology”, clause 6.1 “Forms and methods of operational and investigative activities of internal affairs bodies” of the List of priority areas of scientific support for the activities of internal affairs bodies of Ukraine for the period 2015-2019, approved by order of the Ministry of Internal Affairs of Ukraine dated March 16, 2015 No. 275.

    Counteraction to criminal offenses by criminal investigation units of the Ministry of Internal Affairs of Ukraine: a manual / S.V. Albul, T.S. Demediuk, O.E. Korystin, V.F. Paskal. – Odesa: ODUVS, 2015. – 354 p.

    The manual, based on theoretical analysis and generalizations of materials on the practical activities of operational units of the Ministry of Internal Affairs of Ukraine, considers issues related to the tasks, modern structure and general organization of the activities of criminal investigation units; the concept, content, principles and modes of operational service by criminal investigation units of territories, objects and lines of work are disclosed.

    The organizational and tactical principles of conducting operational prevention by criminal investigation units have been determined. Taking into account the provisions of the current Criminal Procedure Code of Ukraine, problematic aspects of the participation of employees of criminal investigation units in the investigation of criminal offenses have been revealed, in particular, regarding the organization of response to reports of criminal offenses, regarding the participation of criminal investigation employees in conducting covert investigative (search) actions, etc. The issue of organizing the search work of criminal investigation units has been separately analyzed.

    The textbook will be useful for employees of operational units of internal affairs bodies, cadets and teachers of educational institutions of the Ministry of Internal Affairs of Ukraine.

  • Founding of the Association

    Founding of the Association

    On April 23, 2015, the Odessa State University of Internal Affairs (hereinafter referred to as the ODUS) hosted the founding meeting of the founders of the public organization “All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Investigative Activities”. This event is the second important national event for the development of operational and investigative science held at the ODUS, after the field meeting of ORD specialists to agree in November 2012 on the content of the specialty 12.00.09 – criminal process and forensics; forensic examination; operational and investigative activities (in the field of ORD).

    The constituent meeting was held at the initiative of leading specialists of the ODUVD, who invited representatives of Lviv, Kharkiv, Kyiv, Donetsk and Dnipropetrovsk scientific schools of operational and investigative activities to Odessa. According to the organizers of the constituent meeting, the main idea of ​​creating the above-mentioned public organization is to unite the efforts of specialists in the field of ORD to improve the current legislation, scientifically support the development of this branch of law enforcement activity and introduce the latest methods of combating crime.

    During the constituent meeting, a decision was made to establish the public organization “All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Investigative Activities”, its Charter was approved. The purpose of the Association's activities is to promote the development and improvement of the legal system of Ukraine, the development of the theory of operational and investigative activities, the improvement of legislation and law enforcement in this area, raising the level of legal awareness of citizens, supporting scientists and specialists in the field of operational and investigative activities, uniting scientists and specialists who carry out their activities in the field of operational and investigative activities, and promoting the implementation of their recommendations in the practice of legislative activity and the activities of operational units of law enforcement agencies. The objectives of the Association are:

    — scientific enrichment of the theory of operational and investigative activities and the implementation of the results in practical activities;

    — a systematic and qualified approach to the study of foreign experience in the field of operational and investigative activities, criminal intelligence, the latest methods of combating crime, etc.;

    — promoting the reform of law enforcement agencies and other measures aimed at improving the law enforcement system in Ukraine;

    — promoting the coordination of scientific research and educational and methodological activities in the field of operational and investigative activities, exchange of experience on these issues;

    — stimulating scientific research in the field of operational and investigative activities, primarily necessary for solving problems of practical activities of operational units of law enforcement agencies of Ukraine;

    — maintaining and developing domestic traditions and schools in the theory of operational and investigative activities;

    — promoting the work of law enforcement agencies in the development of legislation in the field of operational and investigative activities;

    — organizing and conducting conferences, seminars and trainings for practical employees of law enforcement agencies with the involvement of experts and specialists, including foreign ones;

    — promoting the harmonization of Ukrainian legislation with the legislation of the European Union and the improvement of Ukrainian legislation in the field of operational and investigative activities based on the positive experience of foreign countries;

    — promoting the improvement of the qualifications of scientists and specialists in the field of operational and investigative activities;

    — support for scientific institutions and analytical centers dealing with problems of operational and investigative activities.

    The founders of the public organization “All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Investigative Activities” elected the Head of the Association, Deputy Head of the Association, Secretary of the Association, and members of the Board of the Association. Thus, by a unanimous decision, Doctor of Law, Professor Korystin O.E., Rector of the Odessa State University of Internal Affairs, was elected as the Head of the Association; Candidate of Law, Associate Professor Albula S.V., First Vice-Rector of the Odessa State University of Internal Affairs, was elected as the Deputy Head of the Association; Candidate of Law, Senior Research Fellow Tarasenko R.V., Head of Doctoral and Adjunct Studies at the Odessa State University of Internal Affairs, was elected as the Secretary of the Association.

    The meeting elected members of the Board of the Association in the amount of 6 (six) people:

    — Doctor of Law, Professor Zakharov V.P., Professor of the Department of Operational and Investigative Activities of the Lviv State University of Internal Affairs;

    — Doctor of Law, Professor Nykyforchuk D.Y., Head of the Department of Operational and Investigative Activities of the National Academy of Internal Affairs;

    — Doctor of Law, Professor Orlov Y.Y., Chief Researcher of the Department of Organization of Scientific and Research Work of the National Academy of Internal Affairs;

    — Doctor of Law, Associate Professor Yurchenko O.M., Head of the Interdepartmental Scientific and Research Center for the Fight against Organized Crime under the National Security and Defense Council of Ukraine;

    — Doctor of Law, Senior Researcher Shendrik V.V., Head of the Department of Operational and Investigative Activities of the Kharkiv National University of Internal Affairs;

    — Candidate of Law, Associate Professor Nekrasov V.A., Deputy Head of the Tax Police Faculty for Scientific Work of the National University of the State Tax Service of Ukraine.

    The participants of the meeting decided to determine the person who has the right to represent a public organization in legal relations with the state and other persons and to perform actions on behalf of a public organization without additional authorization, and voted for the candidacy of Korystin Oleksandr Yevheniyovych.

    In general, the constituent meeting of the public organization “All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Investigative Activities” was held at a satisfactory level and in a friendly atmosphere. The participants of the constituent meeting agreed on further cooperation within the framework of the established public organization in the areas of improving the applied principles of combating crime, reforming domestic legislation in the light of European integration processes, etc.

    The meeting discussed and approved the Regulations on the Chairman of the Board and Deputy Chairman of the Board of the Public Organization “All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Investigative Activities”, the Regulations on the Audit Commission of the Association, the Regulations on Entrance and Membership Fees. A lively discussion arose during the development of the work plan of the All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Investigative Activities).

    The participants of the meeting decided to establish ties with higher educational institutions that train specialists in the field of ORD, and practical units of law enforcement agencies that carry out operational and investigative activities; launch a printed series of publications "Theory and Practice of ORD"; organize interaction with the Ministries and departments of Ukraine, which include operational units, in order to determine priority areas of the theory and practice of operational and investigative activities, develop scientific and practical, methodological recommendations for holding events to popularize the activities of the association, etc.

    At the end of the meeting, the Chairman of the Association, Professor Oleksandr Evgeniyovych Korystin, presented the members of the Board with certificates of the All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Investigative Activities.

    We would like to remind you that the public organization "All-Ukrainian Association of Scientists and Specialists in the Field of Operational and Investigative Activities" was founded in April 2015 in Odessa as a voluntary community of leading scientists and practitioners who carry out their activities in the field of operational and investigative activities.
